FELLOWSHIP EXAMINATION DISCLAIMER

The Royal Australasian College of Surgeons (RACS) is committed to ensuring that Candidates’ health and safety is the top priority of running any examination, which includes adhering to any local, state, and federal laws, policies and restrictions, both in Australia and New Zealand, imposed on us, you and any of our venues. Due to the complex evolving nature of these laws and restrictions, as well as RACS’ capability to adhere to them, the delivery format and procedures of these examinations, including their delivery in its entirety, is not guaranteed.

By agreeing to these terms and conditions, you, the Candidate, accept and acknowledge that:

1. Due to RACS’ requirements to comply with both Australian and New Zealand laws, policies and restrictions, its capability to deliver examinations, as well as the delivery format and procedures of those examinations, may be affected at any time leading up to their delivery.

2. RACS may be required to cancel an examination at any time leading up to the examination. This includes an examination in its entirety, as well as specific venues, specific specialties, or examinations for individuals.

4. Registering and producing payment for this examination does not guarantee that RACS will provide the examination to the Candidate. In the event of the Candidate’s exam being cancelled, the Candidate will be entitled to a reimbursement of the examination registration fee (or, where there are separate and discrete examinations or components, for which a separate and discrete fee is payable, the fee for the affected examination or component).

5. RACS cannot guarantee any aspect of the examination’s administration, including but not limited to, the venue, time, and delivery format of the exam. If the date of an exam is postponed, the Candidate will be entitled to a reimbursement of the examination registration fee (or, where there are separate and discrete examinations or components, for which a separate and discrete fee is payable, the fee for the affected examination or component).

6. Notwithstanding any contradictory clause, if any  published changes are made to the delivery format and procedures of the examination between the registration period and delivery of the exam which the Candidate, for whatever reason, believes could negatively impact their performance on the exam, or ability to attend the exam, he/she will be entitled to withdraw from the examination prior to its start date, and receive a  reimbursement of the examination registration fee (or, where there are separate and discrete examinations or components, for which a separate and discrete fee is payable, the fee for the affected examination or component).

7. Where an examination is undertaken by a Candidate, it will be undertaken and assessed against the requisite standard(s) and level of competency as previously established by applicable RACS policies and guidelines.

8. Where a reimbursement of the examination fee applies under any clause contained in this disclaimer, RACS will make every effort to reimburse the Candidate as soon as possible after receipt of your claim (on any required form or via any required electronic modality; however, RACS cannot and does not guarantee the time frame required to finalise such reimbursements. 

9. Reimbursement of examination fees to a Candidate MUST be completed to the same Bank Account/ Credit Card on which the payment was made.

10. You agree that RACS total liability for any cancellation of,  any change to, any disruption of or any  inability to conduct the examination (in full or in part) or due to a Candidate failing the Written component and not progressing to the Clinical/Viva component of that exam  is strictly limited to a refund of the examination fee (or, where there are separate and discrete examinations or components, for which a separate and discrete fee is payable, the fee for the affected examination or component).

 Outside of the Candidate’s registration fee, RACS is not responsible for any costs incurred by the Candidate due to cancellation, changes to, disruption of, inability to conduct the examination or due to a Candidate failing the Written component and not progressing to the Clinical/Viva component of that exam. This includes, but is not limited to, flights, transportation, accommodation, and any other fees and charges. You agree to release RACS from all or any further claims arising from any such eventualities

11. Subject to laws, restrictions, and capacity, in the event of a change or cancellation of their venue, the Candidate may be offered the opportunity to register under a different venue. Any costs associated with attending a different venue will solely be borne by the Candidate. Candidates switching venues will be processed on a first-come, first-served basis.

12. While RACS will publicly communicate any changes made regarding the examination as soon and as clearly as practicable, it is ultimately the Candidate’s responsibility to be aware of such changes and act accordingly.
